Engineering firms rarely find themselves facing significant liability because of one major decision. More often, these situations develop gradually through a series of seemingly minor requests and everyday project decisions.

A quick email. A favour for a long-time client. A comment during a site visit. An RFI answered in a hurry.

None of these decisions feel significant in the moment. But together, they can quietly change the role your firm is expected to play, and the liability that comes with it.

Where Scope Creep Begins

 

At the start of every project, the firm’s role is clearly defined. You’ll design the system, prepare the drawings, review submissions, issue reports, and advise the owner. Your proposal is clear, your fee reflects that work, and your Professional Liability Insurance is based on those defined services.

Then the project becomes messy. A contractor needs urgent guidance. The owner wants reassurance. A client asks for help outside the original scope. A municipality requests clarification before issuing an approval. Everyone is under pressure, and you respond because solving problems is exactly what engineers do.

Unfortunately, that’s where the trap begins.

You might think you’re just being helpful. But a client may assume your firm has accepted responsibility. A contractor could interpret your opinion as formal direction. An RFI response can influence a project decision, while comments made during meetings or on-site may later be viewed as professional advice. Over time, the project record can begin to suggest your firm took on responsibilities beyond its original agreement.

The gap between what your firm agreed to do and what the project record suggests it actually did is where many claims begin.

Scope creep isn’t just a billing issue. It’s a liability issue and, more specifically, an insurance issue. Helpfulness without boundaries can quietly become a liability transfer, leaving firms to absorb risks they never priced, negotiated, or intended to accept.

How Strong Service Can Lead to Unintended Liability

 

Engineering firms are hired to solve problems. That ability builds trust, strengthens client relationships, and keeps projects moving. However, in high-pressure project environments, the desire to be responsive can gradually expand a firm’s responsibilities beyond what it originally agreed to perform.

For example:

  • A civil engineer may be asked to comment on additional drainage issues.
  • A structural engineer may become involved in temporary works.
  • A mechanical engineer may be asked to approve a substitution under a compressed timeline.
  • An environmental consultant may be expected to expand beyond the limits of the original investigation.

In each of these situations, the firm may believe it is simply providing guidance. The receiving party, however, may interpret that guidance as professional direction or an acceptance of responsibility.

When Scope Creep Becomes an Insurance Issue

 

One of the biggest misconceptions about scope creep is that your insurance coverage automatically expands when your responsibilities do. It doesn’t.

Professional Liability Insurance is designed to respond to allegations of negligent acts, errors, or omissions arising from covered professional services, subject to the policy’s terms and exclusions. Expanding your role does not automatically eliminate coverage, but it can create new exposures or contractual obligations that may not align with what was originally underwritten.

In other words, your project may still involve engineering but the liability attached to your evolving role can move beyond the risk profile your insurer originally understood.

That doesn’t mean your policy is inadequate. It means your insurance should be reviewed when your services, responsibilities, or contractual obligations materially change. Your insurance was arranged around the role you describe; not every responsibility you may later assume.

Before accepting additional responsibilities, firms should ask themselves:

  • Is this request outside our original scope of services?
  • Have we clarified our limitations and the responsible party in writing?
  • Have our contractual obligations or responsibilities expanded?
  • Does our current insurance still match the role we’re performing today?

Strong Professional Liability Insurance is one of the most important tools an engineering firm can have. But even the best policy can’t replace good contracts, clear documentation, and disciplined scope management. Insurance performs best as part of a strong risk management strategy not as a substitute for one.

When Contracts Rewrite Your Risk

 

Scope creep doesn’t only occur through conversations and day-to-day project decisions. It can also be created through contractual language.

A contract may look like a standard professional agreement while quietly adding obligations that go beyond your firm’s normal responsibilities. Words such as “guarantee”, “warrant”, “complete responsibility”, or “all losses” can significantly change the risk your firm is agreeing to take on.

And that’s where contractual liability and professional liability can diverge. A contract can expand what your firm owes without automatically expanding what its Professional Liability Insurance covers. Professional Liability Insurance generally responds to negligence arising from covered professional services; it is not intended to absorb broad guarantees, uninsured promises, or responsibilities the firm never priced or controlled.

Documentation Can Become the Weak Link

 

Scope creep doesn’t just change what your firm is doing. It can also make it harder to keep the project record up to date.

When responsibilities expand informally, documentation can easily fall behind. A quick conversation may not get recorded. An RFI may be answered without clarifying who is responsible. Additional work may begin before it’s formally authorized. By the time a dispute arises, the project record may not clearly show how the firm’s role changed or what responsibilities it accepted.

That can make a claim much harder to defend. And when a dispute arises, questions like these become critical:

  • How did your firm respond?
  • Did the firm recognize the request was outside its scope of work?
  • Were limitations clearly communicated?
  • Was responsibility properly documented?
  • Did your firm continue participating after identifying the additional risk?

If those answers aren’t clearly demonstrated through the project documentation, defending a claim becomes significantly more difficult.

Protect Your Firm: Draw the Line Before the Project Draws It for You

 

No engineer wants to be the consultant who delays a project or turns a straightforward request into a contractual debate. But the pressure to be helpful can sometimes lead firms to take on responsibilities they never intended to accept. The strongest firms know that helping their clients doesn’t mean taking on every responsibility that comes their way. They know where to draw the line—and make sure those boundaries are clearly defined, documented, and managed.

1. Documentation Is Your Best Defence

 

Good documentation is one of your strongest risk management tools. When a dispute arises, the project record often becomes one of the most important pieces of evidence.

A few practical steps can help keep your project record clear and protect your firm:

  • Any additional work should be properly authorized.
  • If a client declines a recommendation, record it promptly. Memory fades. Files don’t.
  • If your firm hasn’t recommended or verified work, don’t attach your name to it.
  • If you identify or reasonably suspect a design approach that could lead to failure, clearly document your concerns, your recommendations, and the client’s response. Simply warning the client while allowing the project to proceed may not be enough.
  • Clearly document all limitations, assumptions, qualifications, and observations during limited field reviews and substitution reviews.
  • If contractors request input on means and methods, clearly define where your responsibility ends and theirs begins, and make sure that distinction is documented.
  • No engineer should approve work they haven’t personally verified. Signing off based on assumptions rather than observed facts may still leave the firm legally responsible, regardless of any disclaimers.

2. Make Scope Management Part of Your Culture

 

Ultimately, the firms that manage scope creep best are the ones that build strong risk management practices into their day-to-day operations. Four habits matter most: review contract language before signing, document deviations when they occur, authorize additional work before it begins, and train project managers to recognize scope creep in real time. Insurance should also be regularly evaluated to ensure it reflects the services the firm is actually providing.

Contracts should never be treated as administrative paperwork. They are legal documents that allocate and transfer risk throughout a project. The goal is simple: accept only the obligations your firm can control, perform, and properly insure.

Most importantly, leadership must treat scope creep as a core business risk, not a last-minute administrative task. Clearly defining where your responsibility begins and where it ends is one of the most effective ways to protect your firm. Those boundaries don’t just define the scope of work; they help define the risk your firm is taking on. The strongest firms draw the line early and in writing.
