PROFESSIONAL LIABILITY INSURANCE (E&O)

What is it?
Professional Liability Insurance protects you (and your business) from any allegations of errors, omissions, or negligence committed within the scope of your professional activities. It’ll cover your damages—legal expenses, administrative costs, and court settlements—EVEN if the claims made against you are groundless.

Why do we recommend it?
Independent HR Professionals know that the elements affecting the workplace environment are changing. And while you are change enablers—and we know that change is good—it can also diversify your professional exposures. New legislative policies, technologies, increased demand for contract workers, and even the legalization of certain controlled substances represent a new source of risk while you perform your duties.

We can help. PROLINK has developed an insurance program that addresses the specific risks you face as a HR Professional. Our comprehensive Professional Liability Insurance program will defend you from claims others make against you or your practice within the scope of your professional activities.

Policy highlights include:

  • Specialized coverage designed for eligible CPHR BC & Yukon members providing independent HR consulting and professional services to clients;
  • Limits ranging from $500,000 to $5 million, with no deductible on standard Professional Liability coverage;
  • Coverage available for workplace investigation services;
  • Coverage for services delivered in Canada, with options for U.S. and other international work, subject to underwriting approval and applicable territorial conditions;
  • Teaching and seminar coverage;
  • No-cost policy extension during maternity leave;
  • A 12-month extended reporting period for death, disability, or cessation of practice;
  • Libel and Slander coverage;
  • Funds for Disciplinary Action Expenses and Defence Costs;
  • Occupational Health & Safety Act Expenses;
  • And more!

COMMERCIAL GENERAL LIABILITY INSURANCE (CGL)

What is it?
Commercial General Liability Insurance (CGL) protects your business from third-party claims of bodily injury, property damage, and reputational harm caused by your professional activities or company operations.

Why do we recommend it?
Whether it’s a client, a vendor, or supplier, any business that comes into contact with a third-party needs Commercial General Liability Insurance, especially if you or your employees:

  • Own, rent, or lease a commercial space that’s open to the public;
  • Have a home-based business where clients visit you;
  • Visit your client’s workspace or home, or conduct business anywhere else offsite; and
  • Advertise or create marketing materials for your business.

Policy features include:

  • Coverage for third party injuries and property damage;
  • Standard coverage for Tenant’s Legal Liability, Employer’s Liability, Voluntary Compensation and Non-Owned Automobile Coverage.

PROPERTY INSURANCE

What is it?
Property Contents Insurance protects your commercial property from damage or loss and will cover the costs of repairs or replacement for contents, equipment, and furnishings.

Why do we recommend it?
Property Insurance is critical if you have your own business, regardless of the location. Whether you work from home or out of a commercial office, your general liability or homeowner’s policies won’t reimburse you for any damage to your business assets following a break-in, fire, or other disaster.

DATA SECURITY & PRIVACY BREACH INSURANCE

What is it?
Data Security & Privacy Breach Insurance protects your business and offsets your losses in the event of a breach, such as when your company’s information is stolen or exposed by a hacker, or accidentally released by an employee.

Our valuable policy features include:

  • Legal coaching on how to handle the breach;
  • Legal fees in the case of a civil suit;
  • Funds for court-awarded damages;
  • PR services for managing reputational impact;
  • Provisions for credit monitoring and client notification fees.

Why do we recommend it?

All businesses run the risk of experiencing a cyber/privacy breach at least once in their lifetime. It’s an arms race against fraudsters who are becoming increasingly more sophisticated with their techniques. As an independent HR Professional, you are a steward of private information. Your clients may have even asked you to sign a non-disclosure agreement before engaging in any type of contract.

So, if you or one of your employees were to lose a laptop, experience a network failure, or suffer from a hack that reveals client information—you could suddenly find yourself liable for thousands of dollars in damage. Clients tend to be very forgiving of a privacy breach when it is well-handled by a business. That is, when clients are notified in a timely manner and a sincere apology is made.

However, to accomplish these things during the fall-out from a breach, you’ll need a team of professionals, provisions to keep your business running and funds for any potential damages. PROLINK can help you access all of these services with our Cyber/Privacy Breach Insurance.

FREQUENTLY ASKED QUESTIONS

PROFESSIONAL INSURANCE

What does Professional Liability Insurance cover?

In general, Professional Liability Insurance covers you against allegations brought by a third party (e.g. a client) seeking damages resulting from a negligent or wrongful act, error, or omission arising from your profession and within your scope of practice. The policy will pay for your legal defence costs (e.g. lawyer fees, court costs, etc.). Click here to learn more!

Do I need any other type of insurance if I own or rent an office location?

Yes, you should purchase Commercial General Liability Insurance. The Professional Liability Insurance policy will not defend bodily injury or property damage claims that are related to your premises. You should also consider Property Insurance to protect your office contents.

What do I do if I receive a statement of claim?

Once you are aware of an actual or potential claim, report it to PROLINK immediately. Please refrain from making written or oral statements, and do not offer to compensate or admit liability. Taking such actions could interfere in the insurer’s ability to manage the claim.

When do I need to notify PROLINK with a potential claim?

Please notify PROLINK as soon as you are served with a statement of claim. Additionally, there are other circumstances where you should also contact PROLINK because it could constitute a claim under your Professional Liability Insurance policy.

The other circumstances include:

  • A client or their lawyer issues a verbal or written demand for damages (i.e., a letter or email is sent to you);
  • A client or their lawyer makes threatening comments verbally or in writing indicating that they are seeking damages and/or may sue you.
  • You made a mistake in how you rendered your professional services and may have caused harm to a client.

The Professional Liability Insurance policy is a “claims-made” policy. What does "claims-made" mean?

The Professional Liability and Privacy Breach Insurance policies offered are “claims-made” policies.

Regardless of when a wrongful act takes place, these policies apply only to claims that are:

  • First made against the insured (i.e., you or your firm) during the term of the policy; AND,
  • Reported to the insurance company or PROLINK in writing during the policy period.

What if I have to change something on my policy between renewals?

For any mid-term changes, please email us at cphrbc@prolink.insure.

Does the CPHR BC & Yukon Insurance Program have a common renewal date?

Yes, all members must renew by November 1st each year.

What does Commercial General Liability Insurance cover?

It also provides you with insurance for Tenant’s Legal Liability, Employer’s Liability, Voluntary Compensation, Non-Owned Automobile Coverage, and more.

Why is Cyber Insurance important?

Every business faces the looming threat of a privacy breach during its lifespan. Even the most secure organizations aren’t immune to the tactics of sophisticated fraudsters or mistakes by distracted or poorly trained employees. Ultimately, in today’s digital age, it’s not about if your company will experience a breach—it’s about when.

Without proper controls or security training, you risk losing permanent access to mission-critical data. Plus, if you’re found negligent in the event of a breach, you could be fined up to $100,000 per violation under Canadian privacy laws. Then there are indirect costs of managing breach fallout, like client notification, investigation, business interruption, legal fees, and third-party lawsuits and damages.

Even worse? Diminished goodwill and reputational harm from the breach might even do more harm than remediation costs, especially if you don’t take swift action or notify breach victims right away. Once you’ve lost that trust, it won’t be easy to attract new clients or regain old ones.

That’s where Cyber Insurance comes in. With a comprehensive policy, you can protect your company from financial loss and get ahead of a breach without losing business momentum or taking a massive reputational hit.

What does PROLINK’s Cyber Insurance offer?

Our Cyber Insurance will cover a variety of breach remediation costs incurred by your organization, including:

  • Client notification and credit monitoring for affected parties;
  • Legal defence fees in case of a civil suit, along with funds for court-awarded damages;
  • A legal breach coach to advise you on response and regulatory compliance; and
  • PR consulting services to manage reputational harm.
