PROFESSIONAL LIABILITY INSURANCE (E&O)

What is it?
Professional Liability Insurance protects you (and your business) from any allegations of errors, omissions, or negligence committed within the scope of your professional activities. It’ll cover your damages—legal expenses, administrative costs, and court settlements—EVEN if the claims made against you are groundless.

Why do we recommend it?
As the field of Speech Language Pathology and Audiology diversifies to include new specialties and services, the professional risks you face expand in tandem. No matter how skilled or experienced you are, unpredictable situations can arise that could leave you exposed. And unfortunately, these days unhappy patients increasingly express themselves through costly lawsuits. You need to protect yourself.

Policy highlights include:

  • FREE telephone legal advice offered through your Trisura policy by calling 1 866 945 5207. If you have any questions that require the assistance of a lawyer, the Trisura Legal Assistance Hotline is available from 8 a.m. to midnight (local time), seven days per week. To access this benefit, simply have your policy number ready when you call;;
  • $2,000,000 or $5,000,000 in liability coverage per claim;
  • A $50,000 Privacy Breach Liability Limit is included for no charge. If you maintain confidential client information, it is recommended that you increase your coverage.

COMMERCIAL GENERAL LIABILITY INSURANCE (CGL)

What is it?
Commercial General Liability Insurance (CGL) protects your business from third-party claims of bodily injury, property damage, and reputational harm caused by your professional activities or company operations. 

Why do we recommend it?
Whether it’s a client, a vendor, or supplier, any business that comes into contact with a third-party needs Commercial General Liability Insurance, especially if you or your employees:

  • Own, rent, or lease a commercial space that’s open to the public;

What is it?

DATA SECURITY & PRIVACY BREACH INSURANCE

What is it?
Data Security & Privacy Breach Insurance protects your business and offsets your losses in the event of a breach, such as when your company’s information is stolen or exposed by a hacker, or accidentally released by an employee.

  • Legal fees in the case of a civil suit;

Why do we recommend it?

As a healthcare professional, you are a steward of private personal health information. Unfortunately, since health data is substantially more valuable than other kinds, healthcare professionals are more targeted by cyber criminals than professionals in other industries. There is also the internal risk of employee snooping which is more prevalent than you would think.

You are subject to much stricter privacy regulations and fines—particularly if you are a part of a regulatory College. So, if you or one of your employees were to lose a laptop, experience a network failure, or suffer from a hack that reveals client information—you could suddenly find yourself liable for thousands of dollars in damage. On average, a privacy breach costs $429 for EACH lost health care record. If you have even 100 clients affected by a breach, that could easily amount to a minimum of $42,900 for privacy breach expenses.

PROFESSIONAL INSURANCE

What does Professional Liability Insurance cover?

In general, Professional Liability Insurance covers you against allegations brought by a third party (e.g. a client) seeking damages resulting from a negligent or wrongful act, error, or omission arising from your profession and within your scope of practice. The policy will pay for your legal defence costs (e.g. lawyer fees, court costs, etc.). Click here to learn more!

The Professional Liability Insurance policy is a “claims-made” policy. What does "claims-made" mean?

A “claims-made” policy requires you to have coverage in place both when the event or incident occurred and when it was brought to light (i.e. “made”).

Am I covered for any virtual services I provide?

The Professional Liability Insurance policy provides coverage for advice and services that you provide in a digital format and/or via telehealth (i.e., online or phone). The policy provides coverage for lawsuits and allegations brought against you in Canada only.  

The coverage requirements for online services are the same as in-person services: you must follow the scope of practice as outlined by  your regulatory college.

What if I need to make a mid-term change to my policy?

For any mid-term policy requests, such as updates, address changes, limit increases, additional insured certificates, and more, please contact SLPA@prolink.insure.

Is there a common expiry date for this program?

Yes. All members must renew by April 1st each year.

What is a claim?

An insurance claim is a formal request made by an individual to their insurance company to cover the cost of a covered loss. Most claims are filed following a verbal or written demand for compensation, or the threat of a demand for compensation from a client, partner, consultant, or other third-party.

What do I do if I receive a statement of claim?

The agreement you have with your insurer requires you to inform them anytime there’s a situation that might give rise to a claim. Additionally, your insurer reserves the right to decline a claim if written notice is not provided as soon as you become aware of an incident that may give rise to a potential claim.

As a result, we strongly advise you to notify us immediately in the event that you receive an email, letter, or any verbal notification of a claim related to professional negligence or disservice—even if it doesn’t result in an insurance claim. 

A written notification will not impact your insurance premiums. You can provide details of any potential incident to SLPA@prolink.insure.
