PROFESSIONAL LIABILITY INSURANCE (E&O)

What is it?
Professional Liability Insurance protects you (and your business) from any allegations of errors, omissions, or negligence committed within the scope of your professional activities. It’ll cover your damages—legal expenses, administrative costs, and court settlements—EVEN if the claims made against you are groundless.

PROLINK has tailored a unique Professional Liability Insurance program specific to Alberta’s Dental Assistants. We can help you avoid the holes and discrepancies of generalized cookie-cutter insurance programs, which do not account for unique situations that will apply to diverse professions. PROLINK’s specialized programs will keep you protected so that you can focus on the important things.

Why do we recommend it?
In your career as a Dental Assistant, you’ll face a number of risks. Unfortunately, some things are simply out of your control. While you have your clients’ best interests at heart, misunderstandings happen. In today’s society, misunderstandings translate to legal actions with the power to devastate your professional reputation and finances.

Our program fully complies with and exceeds the requirements of the College of Alberta Dental Assistants (CADA) and will help defend you from claims made against you as they relate to professional negligence, omission of information, or other errors within your scope of practice as an Dental Assistant.

To apply, you must be a member of CADA in good standing. Additional details will be available in the early fall.

FREQUENTLY ASKED QUESTIONS

PROFESSIONAL INSURANCE

What does Professional Liability Insurance cover?

In general, Professional Liability Insurance covers you against allegations brought by a third party (e.g. a client) seeking damages resulting from a negligent or wrongful act, error, or omission arising from your profession and within your scope of practice. The policy will pay for your legal defence costs (e.g. lawyer fees, court costs, etc.) and any damages or settlements payable to a suing party.

The Professional Liability Insurance policy is a “occurrence form” policy. What does "occurrence form" mean?

An “occurrence form” policy covers you for incidents that occur during your policy period, regardless of when a claim is brought against you. This means if your services result in a loss or injury sustained by a client/patient during your policy period but isn’t reported until after your policy expires, your claim can still be covered. You are required to have a policy in effect when the service you provided resulted in the occurrence of an incident. The benefit of an “occurrence” policy is that you are not required to purchase a policy after you stop practicing (i.e., retire or start a different career). This policy meets the requirements of the College of Alberta Dental Assistants.

Occurrence based coverage is different than coverage written on a “claims-made” form. Claims-made policies only cover you when an incident happens, and a claim is filed during your policy period. For losses or incidents that are filed after your policy expires, the professional liability insurance will not cover you.

What do I do if I receive a statement of claim?

Once you are aware of an actual or potential claim, report it to PROLINK immediately. Please refrain from making written or oral statements, and do not offer to compensate or admit liability. Taking such actions could interfere in the insurer’s ability to manage the claim.

What is excluded from the Program for Registered Dental Assistants of the College of Alberta Dental Assistants?

Our Professional Liability Insurance does exclude coverage for:

  • Services not customary for a practicing Dental Assistant or business administrator;
  • Deliberate, Dishonest or Fraudulent Acts;
  • Any occurrence covered by other valid and collectible insurance. In some cases, policy-holders are covered under an employer’s insurance policy. The policy would apply only if coverage under the other policy is insufficient;
  • Any additional liability assumed under contract;
  • Property damage to property in the care, custody, and control of a Dental Assistant.

Is there a common expiry date for the Program?

Yes. All members renew each year on December 1st. Ensure that you are protected! Keep your insurance policy active at all times–you never know when a complaint or legal suit may be brought against you!
