PROFESSIONAL LIABILITY INSURANCE (E&O)

What is it?
Professional Liability Insurance protects you (and your business) from any allegations of errors, omissions, or negligence committed within the scope of your professional activities. It’ll cover your damages—legal expenses, administrative costs, and court settlements—EVEN if the claims made against you are groundless.

Why do we recommend it?

Given the sensitive and unpredictable nature of your profession, mistakes can easily happen, especially in a situation where speed and efficiency can make the difference in saving someone’s life. Whether you’re at fault or not, working in such a high stakes environment means that you could be susceptible to a potential lawsuit.

We can help. PROLINK has partnered with the Paramedic Association of Manitoba to protect you from the specific risks you face as a paramedic. Our Professional Liability Insurance program is included with your PAM membership, meets all regulatory requirements set out by the College of Paramedics of Manitoba, and will protect you in the event of a claim alleging negligence, errors, omissions, or malpractice.

  • Legal defence costs for any complaints filed against you to the College of Paramedics of Manitoba;

ADDITIONAL BUSINESS INSURANCE

Through PROLINK, you can also secure additional coverage for any other businesses you may operate outside of the scope of your paramedic activities. We generally recommend the following coverages for full business protection:

  • Professional Liability Insurance: Protects you (and your business) from any allegations of errors, omissions, or negligence committed within the scope of your professional activities. It’ll cover your damages—legal expenses, administrative costs, and court settlements—EVEN if the claims made against you are groundless.
  • Commercial General Liability Insurance (CGL): Protects your business from third-party claims of bodily injury, property damage, and reputational harm caused by your professional activities or company operations.
  • Property Insurance: Protects your commercial property from damage or loss and will cover the costs of repairs or replacement for contents, equipment, and furnishings.
  • Data Security & Privacy Breach Insurance: Protects your business and offsets your losses in the event of a breach, such as when your company’s information is stolen or exposed by a hacker, or accidentally released by an employee.

PROFESSIONAL INSURANCE

What does Professional Liability Insurance cover?

In general, Professional Liability Insurance covers you against allegations brought by a third party (e.g. a client) seeking damages resulting from a negligent or wrongful act, error, or omission arising from your profession and within your scope of practice. 

I’ve purchased a membership through the Paramedic Association of Manitoba. Do I need to do anything else to obtain the Professional Liability Insurance?

No. Your Professional Liability Insurance is included in your PAM membership. Once you’ve registered and paid for your membership and insurance, your policy documents will be sent by email shortly after.

Does the Professional Liability Insurance through PAM meet the requirements as set forth by the College of Paramedics of Manitoba?

Yes. The Professional Liability Insurance through PAM is fully compliant with all requirements set out by the College of Paramedics of Manitoba. 

Who handles the administration of the insurance program?

The Paramedic Association of Manitoba head office handles the administration of the Professional Insurance program. They can be reached at info@paramedicsofmanitoba.ca.

Is there a common expiry date for the Insurance?

Coverage is available from the date of purchase and expires on January 1.

The Professional Liability Protection starts at $5,000,000 in coverage. What will $5,000,000 pay for?

We’ve all heard media reports of medical professionals or organizations being sued for damages to a victimized third party. But damages are typically only one part of the claim that would be paid out by an insurance policy. The majority of your claims payout will go towards the legal fees and expenses required to mount a defence. Plus, even if damages aren’t awarded to a victim, lawyers will still need compensation. Currently, the average fee for a lawyer specializing in medical malpractice insurance in Canada is $500-$700 per hour. Fortunately, your policy’s liability limit will pay for all reasonable and necessary costs, charges, fees, and expenses incurred over the course of an investigation, negotiation, arbitration, and defence of any covered claim.

What do I do if I receive a statement of claim?

Once you are aware of an actual or potential claim, report it to PROLINK immediately. Please refrain from making written or oral statements, and do not offer to compensate or admit liability. Taking such actions could interfere in the insurer’s ability to manage the claim.

What happens if I change jobs, work for more than one employer, volunteer elsewhere?

As long as you are a member of PAM and working in Canada, this coverage will cover you in all of these situations for your paramedic services.

Am I covered if a patient accuses me of abuse?

Criminal acts such as molestation, harassment, corporal punishment, assault or battery, or any form of sexual or physical abuse are not covered under this Professional Liability Protection policy. If however, you are successfully acquitted, received a “not guilty” verdict or the charges are withdrawn, this policy will reimburse you up to $50,000 for legal expenses incurred to defend you.

What if I want to purchase separate insurance for any side business I operate?

What is the policy territory?

Under the Paramedics of Manitoba Insurance Program, the policy territory is Canada wide (and its territories); however, in non-regulated provinces, coverage is restricted to those operating as employees only.
