PROFESSIONAL INSURANCE FOR DC MEMBERS

PROFESSIONAL INSURANCE FOR DIETITIANS

What is it?
Professional Liability Insurance (E&O) protects you (and your business) from any allegations of errors, omissions, or negligence committed within the scope of your professional activities. It’ll cover your damages—legal expenses, administrative costs, and court settlements—EVEN if the claims made against you are groundless.

Commercial General Liability Insurance (CGL) protects your business from third-party claims of bodily injury, property damage, and reputational harm caused by your professional activities or company operations.

Why do we recommend it?

As a Dietitian, you help clients correct their food and nutrition practices to improve their well-being. Your work has made you aware that each client has a unique body, personality, and even understanding of the world. As a result, you must continuously adapt your approach to suit their individual needs. Still, despite all of your best intentions, unforeseen health complications can arise and your advice can easily be misconstrued, resulting in a demanding and dissatisfied client. Lately, such clients express their discontent by filing expensive lawsuits. You could find yourself personally liable. But we can help you avoid that.

PROLINK—Canada’s Insurance Connection has worked closely with the Dietitians of Canada to develop a Professional Insurance program that offers Dietitians comprehensive protection and meets and exceeds any regulatory requirements, should something occur.

Professional Liability Insurance Features:

  • Legal Expense Reimbursement: offers up to $50,000 for reimbursement for all reasonable legal expenses incurred if you must appear before any regulatory hearing in Canada. Receive up to $250 per day for any lost wages if you must attend pre-trial, trial, or appeals;
  • Criminal Defence Reimbursement: access up to $100,000 for criminal charges arising from malpractice charges provided you are found not guilty;
  • Cyber Security and Privacy Liability Extension: obtain $50,000 in coverage which includes protection for Network Security Liability, Privacy Liability, and Electronic Media Liability in the event of a Cyber Breach that compromises your business or client data;
  • Abused Patient Therapy & Counselling Coverage: limit of $10,000 per member with an all-member aggregate of $100,000;
  • Automatic no-cost policy extension for materntiy/paternity leave;
  • Unparalleled rates for DC Members!

Commercial General Liability Insurance Features:

  • Covers exposures resulting from third party injuries, property damage, invasion of privacy, wrongful entry, and humiliation and discrimination.
  • Additional Insured Endorsements can be added on request for ‘all government, municipalities, public institutions or hospitals in Canada’ with respect to their liability resulting from the insured member’s work.

PROFESSIONAL INSURANCE

What does Professional Liability Insurance cover?

In general, Professional Liability Insurance covers you against allegations brought by a third party (i.e., a client) seeking damages resulting from a negligent or wrongful act, error, or omission arising from your profession and within your scope of practice. 

Professional Liability Insurance is a “claims-made” policy. What does "claims-made" mean?

“Claims-made” policies require you to have a policy in effect when a claim is reported (made) in order for coverage to apply. Any claims are covered under the policy that is in force at the time and NOT the policy in force when the occurrence took place.

What do I do if I receive a statement of claim?

Once you are aware of an actual or potential claim, report it to PROLINK immediately. Please refrain from making written or oral statements, and do not offer to compensate or admit liability. Taking such actions could interfere in the insurer’s ability to manage the claim.

Who handles the administration of the insurance program?

This program is administered by the head office of Dietitians of Canada. They can be reached at 416 596 0857 or CentralInfo@dietitians.ca.

Will the Professional Liability Insurance policy protect me if a complaint is filed against me with my Regulatory Body?

The chance of having someone file a formal complaint against you is greater than the chance of being sued. There are different regulatory bodies in each province; however, this policy will provide access to lawyers who specialize in defending professionals being investigated by a regulatory body or authority due to a complaint.

Will the Professional Liability Insurance policy protect me if I am charged with a criminal offence?

The policy will reimburse you for the legal defence costs incurred in a criminal action related to their services if the criminal charges are dropped or if you are found not guilty for the offence.

Do I need any other type of insurance if I own or rent an office location?

Yes, you should purchase Commercial General Liability Insurance. Professional Liability Insurance will not defend you against bodily injury or property damage claims that are related to your premises. You should also consider Property Insurance to protect your office contents.

What is a retroactive date?

Retroactive Date: Any claims that arise from incidents that occurred before this date are excluded from your policy.

Why is Commercial General Liability Insurance important?

Unfortunately, you can be sued for any injuries or property damages that occur while working with clients—even if you’re not at fault. This situation is so common that most venues, government parties, and corporations require that you have this type of coverage in place before you engage in any contract.

Additionally, if you run your business from home, you could be at risk. For example, if a delivery man slips and falls delivering a work-related package, your typical home owner’s policy may not cover it. Commercial General Liability Insurance will.

What does Commercial General Liability Insurance cover?

Commercial General Liability Insurance covers you in the case of third party injuries and property damage that occurs through your professional activities. It also provides you with insurance for Tenant’s Legal Liability, Employer’s Liability, Voluntary Compensation, Non-Owned Automobile Coverage, and more.

Is there coverage available if I have Corporation?

Yes, coverage is available provided you are the only employee/consultant dietitian working under the Incorporated Entity. 

Can I add a third party to my Commercial General Liability Insurance?

Yes, CGL certificate requests for municipalities and government bodies (for additional insureds) can be completed at the DC head office. Please contact DC at CentralInfo@dietitians.ca. Please note: for certificates that are non-government or non-municipalities, please contact DC@prolink.insure or 416-595-7484.

Is there a common expiry date for the insurance?

Coverage is available from the date of purchase and expires at the end of your membership period.
