PROFESSIONAL LIABILITY (E&O) AND COMMERCIAL GENERAL LIABILITY (CGL) INSURANCE

What is it?
Professional Liability Insurance protects you (and your business) from any allegations of errors, omissions, or negligence committed within the scope of your professional activities. It’ll cover your damages—legal expenses, administrative costs, and court settlements—EVEN if the claims made against you are groundless.

Commercial General Liability Insurance (CGL) protects your business from third-party claims of bodily injury, property damage, and reputational harm caused by your professional activities or operations.

PROFESSIONAL INSURANCE

What does Professional Liability Insurance cover?

In general, Professional Liability Insurance covers you against allegations brought by a third party (i.e., a client) seeking damages resulting from a negligent or wrongful act, error, or omission arising from your profession and within your scope of practice.

What does Commercial General Liability Insurance cover?

Commercial General Liability Insurance covers you in the case of third party injuries and property damage that occurs through your professional activities. It also provides you with insurance for Tenant’s Legal Liability, Employer’s Liability, Voluntary Compensation, Non-Owned Automobile Coverage, and more.

What do I do if I receive a statement of claim?

Once you are aware of an actual or potential claim, report it to PROLINK immediately. Please refrain from making written or oral statements, and do not offer to compensate or admit liability. Taking such actions could interfere in the insurer’s ability to manage the claim.

When do I need to notify PROLINK with a potential claim?

Notify PROLINK as soon as you are served with a statement of claim. However, there are other circumstances where you should also contact PROLINK because it could constitute a claim under your Professional Liability Insurance policy.

The other circumstances include:

  • A client or their lawyer issues a verbal or written demand for damages (i.e., a letter or email is sent to you);
  • A client or their lawyer makes threatening comments verbally or in writing indicating that they are seeking damages and/or may sue you.
  • You made a mistake in how you rendered your professional services and may have caused harm to a client.

What if I have to change something on my policy between renewals?

What is the minimum and maximum policy term?

We recommend that you purchase insurance coverage for the duration of your contract. You can purchase coverage for as little as one week going all the way to 18 months. If your contract goes beyond 18 months, you will be able to renew your policy near the expiry date. We send out automatic reminders beginning 60 days out.

I see that the program includes two policies. What are these and why do I need both?

Both the Professional Liability (“E&O”) and Commercial General Liability Insurance (“CGL”) policies are required to adequately protect you if you are incorporated or a sole proprietor. The E&O coverage protects against mistakes which cause financial loss to a third party. CGL coverage is focused on protecting you from claims as a result of bodily injury or property damage to a third party for whom you are legally liable.

Please note there are some limitations/restrictions. Please refer to the policy wordings for more guidance. 

What requirements do I need to meet in order to be eligible for coverage?

In order to participate in the NACCB Independent Contractors Insurance Program, you must only be doing work through ONE staffing company. If you do work for multiple staffing companies, or other independent work, please contact us at ICP@prolink.insure, so that we can help you find coverage to fit your needs perfectly.

Will the Independent Contractors' Program protect me for my own consulting activities (with other clients) that I also perform from time to time?

No. The Independent Contractors’ Program only protects you for E&O and CGL claims arising out of the work you do on behalf of your member staffing company. Please contact PROLINK to discuss options to insure all of your activities.

How do I purchase coverage?

You can buy coverage securely online. Once you contact us and we confirm that you meet the requirements for our program, we will send you an email link where you can complete the application online.

Once purchased, we will email your Certificate of Insurance, policy documents, a receipt, a completed application, and a privacy disclosure document.

How do I renew or extend my insurance coverage?

Before your policy expires, you will receive a reminder email containing a link to renew. Please click this link to renew your policy. Sometimes the email may end up in your spam folder. Please check there.

When will my coverage become effective?

Coverage is effective the date you sign up (or the starting date you select) AND your payment is received. Coverage cannot be backdated.

In whose name will the documents be issued?

If you are incorporated, and are the sole employee, the insurance documents will be issued in the name of your corporation. As an employee of your incorporated company, the coverage automatically extends to you.

If you are a sole proprietor (unincorporated), the documents will be issued in your name personally.

Do I need to confirm coverage to my member staffing company?

You should forward your Certificate of Insurance to your staffing company as proof of coverage and to fulfill your contractual obligations to your staffing company.

What limits are available?

You have choice of a $1 million, $2 million, or $5 million limit.

Is there a deductible?

There is a $1,000 deductible. However, please note that this deductible does NOT apply to your defense costs.

Does the policy cover legal fees?

All defense costs (subject to policy limits) are covered. Victor Insurance (the insurer) has access to some of the best lawyers in the country.

What is the cost of coverage?

Pricing depends on the services you provide, the limits you select and the length of your policy. The length of your policy period can be anywhere from one week up until 18 months.

What are the payment options?

Credit card is the only method of payment for this program.
